In some states, Lemon Laws do indeed apply to used cars, but the coverage is often more limited than for new vehicles. Generally, these laws apply to used vehicles still covered under the original manufacturer's warranty or a dealer's express warranty. If your used car qualifies and continues to have substantial defects after multiple repair attempts, you may be entitled to a refund, replacement, or compensation for repair costs.

State-Specific Variations

Lemon Law protections for used cars differ significantly from state to state. Some states have robust laws that cover used vehicles, while others offer limited or no protection at all. For instance, states like California and New York have specific provisions for used cars under their Lemon Laws, while others may only provide recourse through general consumer protection laws.

Here in Indiana, our lemon law is called the Motor Vehicle Protection Act. Because this law doesn’t differentiate between new and used cars, as long as the warranty is still in effect, dealers are required to replace or refund a consumer if they are unable to remedy a major problem within 18 months or 18,000 miles. For Lemon Law used cars in Georgia, the law that requires the manufacturer to replace or buy back (repurchase) the vehicle, unfortunately only applies to new vehicles.
